Start by Verifying Ownership
Don't let the apartment distract you from the land it stands on.
Before moving forward, ask for the Title Deed. It establishes the seller's legal ownership and their right to transfer the property. Kerala RERA also requires promoters to disclose their legal title to the project land.
Alongside the Title Deed, review the Encumbrance Certificate (EC). This document records registered transactions affecting the property and helps identify mortgages or other registered liabilities for the period covered by the certificate. For older or resale properties, your legal advisor may also examine the Mother Deed to establish the property's chain of ownership.
Confirm That the Project Has the Required Approvals
A project should satisfy both design expectations and statutory requirements.
If the development falls under the Real Estate (Regulation and Development) Act, verify its registration through the Kerala RERA portal. Registered projects provide buyers access to approvals, project information and mandatory disclosures submitted by the promoter.
Ask to review the approved building plan and the building permit issued by the competent authority. Under the RERA Act, a commencement certificate includes the building or construction permit issued to begin development according to the sanctioned plan.
Understand the Documents That Govern the Purchase
Many buyers compare specifications in detail but spend little time reviewing the documents they'll eventually sign.
The Agreement for Sale records important commercial terms, including the payment schedule, possession timeline and the responsibilities of both parties. Kerala RERA prescribes the format of this agreement and protects the allottee's rights under the Act.
The Sale Deed comes later. This is the document that legally transfers ownership after registration. Before signing, make sure the property details, agreed consideration and buyer information are recorded correctly.
Request a detailed cost sheet as well. It should clearly distinguish the apartment price from additional charges such as stamp duty, registration charges, GST where applicable, parking charges, maintenance deposits and corpus fund contributions. A transparent cost breakdown makes it easier to compare projects and plan your finances.
Review the Documents Issued Before Possession
The buying process doesn't end when construction is complete.
For completed projects, ask whether the Completion Certificate (CC) and Occupancy Certificate (OC) have been issued.
The RERA Act defines the Completion Certificate as the document issued by the competent authority confirming that the project has been completed according to the sanctioned plans and specifications.
The Occupancy Certificate confirms that the building is fit for occupation under the applicable local regulations. Before taking possession, it's also worth reviewing the latest property tax receipts, particularly for completed or resale properties, to confirm there are no outstanding municipal dues.
